LEGAL DISCLAIMER and contractual amendments The following text is a legal document that accompanies any signature given by the person posting this personal home page, Emil N. Coman, and any verbal or written contract between Emil N. Coman and any other party.
1. By
engaging in a contractual relationship with me, Emil N. Coman, any and every
written, electronic or other type of signature or agreement I am
issuing will equally and
legally entail the content of this
disclaimer as a legal amendment to the contract, beginning today, Sept. 28,
2002, the day of the posting.
2. None of my written,
electronic, or otherwise signatures or agreements provided by
me, Emil N. Coman, is valid unless the other contractual party is aware of and
agrees with the amendments specified in this legal disclaimer.
3. Rendering the product
purchased or providing the service ordered by me, Emil N. Coman, implies
acknowledgment by the other contractual party of the terms of the amendments in
this legal disclaimer.
4. Any attempt made by the
provider of a service or seller of a product to overcharge me, by either
changing the terms of the initial contract without notice, charging for a
service that was not provided, providing a service at a quality below the
contractual terms, claiming balances owed without documentation, or any other
form of overcharge, will incur an overcharge fee of US$ 20.00 payable to Emil
N. Coman from the moment the attempt has been made.
5. Any contractual clause
specifying "prices can change without notice" will assume, through my
signature, that indeed prices may change without prior notice, but the other
contractual party obliges itself to provide me, Emil N. Coman, with a written
notice of the price change, immediately after the change has taken place.
6. I reserve the right to cancel a payment made by credit card
or check in case the service or product was not rendered or it was
unsatisfactory, until the matter is resolved by written correspondence between
me and the other party, or through a third party arbitration agent.
7. A daily interest rate of 0.04%,
is applied to any amount owed to me, from the moment a refund, overcharge fee,
or any other type of debt is owed to me.
